E&L COMEATMENT: Loyalty Program (Terms & Conditions)

TERMS AND CONDITIONS

 

  1. These terms and conditions (“Terms”, “Conditions” or “terms and conditions”) govern the collection and use of points and set out the terms of contract between E&L Faster Food Imports Inc., (“E&L”, the “Company” “us” or “we”) and you, the customer relating to the E&L COMEATMENT (“Loyalty Program”). You can join the Loyalty Program by registering your account in Shopify (“Website”). By registering with us, you automatically consent and accept the foregoing terms and conditions.

       However, we may refuse your application with our Loyalty Program for any reason at our sole discretion including, but not limited to, risk of reputational damage to us, any reasonable suspicion of previous unlawful activities including rude, abusive, and/or offensive behavior towards our customers, representatives, or any previous history as joy-reservers.

  1. To register with our Loyalty Program, you need to completely provide your contact details on our website at www.enlfood.com. A Loyalty Account will be created under your name, which will record and collect points to be earned or redeemed by you. Must be at least eighteen (18) years of age or with legal capacity to enter into agreements.
  2. You are entirely responsible in maintaining the confidentiality and security of your Loyalty Account, which includes your security details and the transactions and/or redemption of points you made. You shall not share your Loyalty Account username and password with anyone, including any E&L staff. In the event that there are unauthorized access or any suspicious activity with your account, you should promptly contact the member helpline at (+63) (02) (8) ENL-FOOD.
  3. Your Loyalty Account is used to earn points at our online shop, www.enlfood.com.Details as to how points can be collected and redeemed appear below.
  4. Loyalty Points are personal and non-transferrable. Loyalty Points may only be redeemed and earned in accordance with these Terms.
  5. The Loyalty Program is only for consumer or for the end user and it cannot be used for any transaction where the beneficiary is a business entity or for any other commercial purposes. Only one consumer can be associated per customer account.
  6. You Loyalty Account may be terminated for the following reasons:
  7. You had materially breached these Terms, and if such breach can be remedied, it has remained unremedied within a period of thirty (30) days from receipt of the written notice of the breach from E&L; and
  8. if E&L reasonably believes that you have the Loyalty Program, such as hacking (i.e., creation of multiple accounts), fraud or collusion with E&L employees and unusual redemption activities.

Once your Loyalty Account is terminated, any points earned and not redeemed may be cancelled and will be closed permanently without prior notice. E&L reserves the right to take any action deemed necessary where a Loyalty Account holder is found to have abused the Loyalty Program.

  1. In addition to the above, E&L reserves the right to (i) stop the program at anytime if we decide to terminate the Loyalty Program; (ii) to alter or amend the terms and conditions of operation of the Loyalty Program by publishing notices on our website www.enlfood.com; and/or (iii) withdraw or cancel the Loyalty Account, points and rewards (including but not limited to the redemption and issue of such) on reasonable notice to you by letter, email, or publishing such notice on our website at www.enlfood.com.
  2. Our Privacy Policy relating to this Loyalty Program (which can be accessed at www.enlfood.com) sets out the information that we will collect about you, how we use the information, and whom it may be shared with including, but not limited to, details of the promotional information that we hope to provide.
  3. We will retain your personal information for as long as you are a member of the Loyalty Program. You may cancel your membership at any time by contacting us at onlineshop@enlfood.com.
  4. The Loyalty Program is operated and promoted by E&L Faster Food Imports Inc, 232 Sumulong Highway, Antipolo City, Rizal, Philippines 1870. The Loyalty Program helpline can be contacted at 0905 177 5584.

 

  1. How to earn Meat Points
  2. To collect points, click the Earn Points in the rewards widget icon (COMEATY). Every activity corresponds to certain points, namely as follows:
  3. Creating an Account or Welcome Bonus is equivalent to 100 points
  4. Completing your Profile is equivalent to 50 points
  5. Celebrating your Birthday is equivalent to 200 points
  6. Subscribing to our Mail is equivalent to 20 points
  7. Celebrating your Membership Anniversary is equivalent to 1000 points
  8. Completing your order is equivalent to 500 points for every successful transaction.
  9. Social Share includes following our social media accounts which is equivalent to 200 points.
  10. Referring a friend will give you Php 50 off upon checkout for every successful transaction, and your friend will automatically receive 50 points; and
  11. Other promos or eligibility points that E&L may promote in the future.
  12. Points cannot be earned on the purchase of gift cards or gift vouchers.
  13. The amount of points awarded can be altered at the discretion of E&L.
  14. E&L reserves the right to offer bonus points on certain products as selected by us from time to time and in our sole discretion.
  15. Points will automatically be added to your account for every accomplished “how-to-earn-points" steps, except in the circumstances of system failure when it is expected that points will be loaded within twenty (24) hours. In most circumstances, any bonus points earned will be added to your Loyalty Program forty eight (48) hours after the goods are purchased. Points cannot be redeemed until credited to your account.
  16. E&L reserves the right to edit points of the members (e.g. add points) considering the reward/s that will be awarded at a given point of time.
  17. E&L is entitled to cancel points awarded if the relevant products to which such award relates to are returned for any reason and a refund of the purchase price is given. If the relevant products are exchanged for other products, the points awarded will be adjusted upwards or downwards depending on whether the exchange is for a higher or lower value item.

III. How to get your Unlimeated Rewards and Redeem Meat Crates

  1. To receive the Unlimeated Rewards in the form of E&L Meat Points, you will be notified via email, text message, and direct call to all Loyalty Account holders who have accumulated a total of at least three thousand (3000) Meat points every end of the month.
  2. E&L Meat Crates Vouchers will be issued in multiples of one hundred (100) points.
  3. E&L Meat Points are valid until the expiry date detailed on the voucher sent via email, text message, or app account.
  4. Where E&L Meat Crates Vouchers are being used as full payment for goods of a lesser value, no change will be given.
  5. The value of the E&L Meat Points will be shared out pro-rata across all items purchased.
  6. Returned goods purchased or redeemed in full or part using E&L Meat Points will be given a refund provided that the reason for return is validated and approved. 
  7. E&L Meat Crates can only be redeemed online at www.enlfood.com.
  8. E&L Comeaty Members who do not reach the minimum number of points needed to qualify for a reward by the end of the collecting period will have their points carried over to the next collecting period.
  9. No replacements will be given to unvalidated returns. Refer to the Customer Returns and Refunds policy below.
  10. E &L reserves the right to withdraw the Loyalty Program at any time.

IV. Customer Returns and Refunds Policy 

  1. E&L Faster Food Imports, Inc. and its affiliated companies (“E&L”) hopes that you are pleased with your purchase. Should you wish to return anything purchased, we will be pleased to credit your account the value of the purchase, provided it complies with the conditions stated herein. Returns should be made within seven (7) days from the date of your receipt of the product/s by informing our sales agent in writing via email or text message for documentation purposes, of your intention to return the product and arranging its return within the period mentioned.

 

  1. Returns are only acceptable for the following reasons:
  2. The item delivered was wrong and not the item ordered;
  3. The quantity of the item delivered was more than the quantity ordered;
  4. The actual item inside the box is different from what is stated in the label; and
  5. The quality of the item fails quality standards, and such is not attributable to the fault of the purchaser (i.e. foul odor, discolored, spoiled, rotten, expired, etc.).

 

  1. In relation to par. 2 (a) to (c), the product/s must be in its original packaging, unopened, and in good condition and we reserve the right to refuse the return if these conditions are not met.

 

  1. Once the return request has been granted by the agent, the item can be returned to the E&L warehouse located at Apex Cold Storage Inc., Sumulong Highway, Barangay Mambugan, Antipolo City, Rizal. In cases that you cannot physically return the product to our warehouse, our delivery team will promptly schedule the pick up of the returned item.

    The scheduled pickup shall not be more than five (5) days from the granting of the return request.

 

  1. After the return, the Credit and Collections Department will issue an applicable Company’s credit memorandum. The credit memorandum can be applied on any of your existing invoice/s or to any of your succeeding purchase/s.

  1. Terms and Conditions

This policy is subject to the following terms and conditions:

  1. All invoice/s shall be paid within the agreed terms with the Company. You shall be declared in default for failure to pay any amount within the agreed term.

 

  1. In case of default in payment, you shall be liable for a monthly interest fee of 1.5% or at 18% per annum for each month following the due date that an invoice remains unpaid. E&L shall also be entitled to reasonable attorney's fees and costs of litigation, in addition to such other damages that it may claim by reason of your default.

 

  1. Any and all requests for return of merchandise shall be subject to the E&L Returns and Refunds Policy.

 

  1. E&L reserves the right to withhold granting you credit for the following reasons, among others: overdue invoices, you had exceeded the credit limit, issuance of a bounced check, and such other reasons that reasonably justify the withholding of such grant of credit.

 

  1. You hereby agree to pay an additional fee of Php500.00 for every returned check without prejudice to such other remedies or actions that are available to E&L.

 

  1. You further agree that, in case of dispute, the venue for litigation between the parties shall be exclusively in the proper courts of the City of Antipolo, Province of Rizal.

Our Privacy Policy governs the use of our website and explains how we collect, use, safeguard, retain, dispose and disclose information that results from your use of our web pages.   4. The Data Subject withdraws consent or objects to the Processing, and there is no other legal ground or overriding legitimate interest for the Processing by the Company;
  5. The Personal Data concerns private information that is prejudicial to the Data Subject, unless justified by freedom of speech, of expression, or of the press or otherwise authorized;
  6. The Processing is unlawful; or
  7. The Data Subject’s rights have been violated.

The Data Subject may, upon knowledge of the circumstances given above and as soon as practicable, notify and coordinate with the Company’s customer representative.

Usage Data is collected automatically when using our website, subscribing to our email campaigns, or participating in our survey.
